Conditions & Terms of Sale

The following are the RI Marketing & Advertising Company Printing & Marketing Agreement, Terms & Conditions of Sale as of June 2004. Terms, Agreements, and conditions may change with out prior notice. Please refer back to this page for the latest terms & conditions information.

1. Pricing

Published prices obtained from RI Marketing & Advertising are subject to change without notice. All published prices and written quotations will be honored for 30 days after the date of the original quotation.

2. Payment Terms

All orders must have a 50% deposit prior to commencement of work. Payment may be in cash, a company or personal check, money order, by credit card (Visa, Master Card, American Express, Discover), or electronic payment method such as PayPal. There will be a $25.00 fee for returned checks in addition to the original amount due. Invoices outstanding over 30 days are subject to a 1½% finance charge. 3. Payment by Credit Card

Client paying by credit card agrees to be bound by RI Marketing & Advertising, Terms & Conditions, as well as Design Specifications. Card holder and client specifically agree to pay all costs incurred if their order is prematurely cancelled and it is understood that no credit card will be provided for returned orders. Client agrees to supply a copy of the front and back of their credit card if requested for signature comparison. The order amount will be changed to the credit card at the time the order is submitted.

4. Returns for Credit

Orders returned for credit must be done so at the Client’s expense. No credit will be issued without the prompt return of the entire order. Credit may only be applied to replacement or future orders. No refunds will be provided. Company credit only.

5. Order Cancellation

Due to our production schedule, no order may be canceled after acceptance, expect upon terms that will compensate RI Marketing & Advertising at our regular hourly rates. There is a minimum $150.00 cancellation fee for cancel order requests after 36 hours from initial sales order.

6. Warranty

RI Marketing & Advertising at its sole option will repair or reprint any order that we have failed in adhering to written Client instructions or written approval. Claims for design defects/damages must be made by the Client in writing within (10) days after delivery. RI Marketing & Advertising sole liability shall be limited to the reprinting of any design defective order or portion and in no case shall include special or consequential damages including customer expenses, profits or lost. No refunds will be provided. Company credit only will be issued.

7. Indemnification

Client hereby affirms ownership and/or publishing rights to all artwork, photos and other materials submitted for designing/printing and agrees to indemnify and hold harmless RI Marketing & Advertising and its affiliates and employees from any and all loss, cost expense, and damage on account of any all manner of claims, demands, actions, and/or proceedings that may be levied against RI Marketing & Advertising on the grounds that said designing/printing violates any copyright or proprietary right of any person, or that it contains any matter that is libelous or scandalous, or invades any person’s right to privacy or personal right. RI Marketing & Advertising reserves the right to refuse an order, if, in RI Marketing & Advertising’s judgment, fulfillment of the order would violate the U.S. Copyright/Trademark Laws or involve obscene or pornographic material. The client agrees to, at the Client’s own expense, promptly defend and continue the defense of such claim, demand, action, or proceeding that may be brought against RI Marketing & Advertising provided that RI Marketing & Advertising shall promptly notify the Client with respect thereto.

8. Customer Digital Files

Clients are 100% responsible for the accuracy of your layouts. Please proofread all layout proofs carefully. Your signature is required on all samples and signifies that you have proofread and approve the samples for production.

9. Color Matching

Due to the differences in equipment, paper, inks and other conditions between color proofing and production, a reasonable variation in color between color proofs and the completed job is expected. All postcards are “gang printed,” not printed as separate individual orders. RI Marketing & Advertising will reproduce color from submitted transparencies, slides or photos as closely as possible, but cannot exactly match color and density because of limitations in the printing process, as well as neighboring image ink requirements. The accuracy of each color reproduction is guaranteed to be within approximately 85 to 90% of the original images submitted. RI Marketing & Advertising accepts no responsibility for color variations between submitted images and the actual artwork or product they represent.

10. Shipping & Handling

All shipping and handling are additional to cost of the designing/printing order unless otherwise specified herein. All shipments are handled by United Parcel Services (otherwise specified) and delivery is usually 2-3 business days after production is complete.
